RECENT CASES

The following is a list of recent MJS Law cases and outcomes:
  • R v R.V.D. Client charged with 2nd degree murder. Both co-accused who had pled guilty to manslaughter and “getaway driver” testified as to clients involvement and in particular that the client had shot the victim twice. Found Not Guilty.

 

  • R v A.H. Charge of sexual assault. Client placed on a peace bond (basically a restraining order) No criminal record.

 

  • R v D.D. Client was charged with unlawful possession of a firearm carrying a 3 year minimum jail sentence. Charter issues related to the search were raised to Crown. Stay of proceedings entered ahead of trial.

 

  • R v S.T. Charges relating to a marihuana grow operation. Defence was prepared to argue Charter breaches. Stay of proceedings entered on the trial date.

 

  • R v G.S. Client charged with three counts sexual assault, seven counts assault and two counts uttering threats. Client denied allegations with the exception of two assaults, however, disputed the factual circumstances as alleged relating to those two assaults. Not Guilty on all counts denied, and convicted on the two assaults admitted, but on the facts testified to and not alleged.

 

  • R v R.M. Dial-a-dope drug trafficking charges of crystal methamphetamine. Crown sought 6 months jail. Conditional sentence order granted. No jail.

 

  • R v R.K. Client charged with two robberies, theft of a motor vehicle and possessing stolen property, theft of merchandise and operating a motor vehicle while disqualified. Client had a lengthy criminal record including convictions for: multiple robberies, forcible confinement, multiple break and enters, multiples thefts, multiple assaults, assault causing bodily harm, assaulting peace officer, escape from lawful custody, and dangerous operation of a motor vehicle amongst other numerous other convictions. Client had spent the majority of his adulthood incarcerated. Crown sought 3-4 years jail. Client received a conditional sentence order. No jail.

 

  • R v M.C. Note passing robbery of a convenience store. Crown sought 18-24 month jail term. Client granted a conditional sentence order. No jail.

 

  • R v F.M. Client charged with domestic assault.  Not Guilty.

 

  • R v C.G. Client charged with aggravated assault arising from an street brawl after the Olympics. Extensive cross examination of civilian and police witnesses. Not Guilty.
